PETITION FOR APPOINTMENT OF GUARDIAN OVER A CHILD SPECIAL FINDINGS REQUESTED
COMES NOW, Petitioner, EDIN ARNOLDO CORDON-SOSA, by and through his attorney, STEVE JIMENEZ, ESQ., of GONZALEZ LAW FIRM, in accordance with Chapter 159.044 of Nevada Revised Statutes, whose Petition respectfully represents the following to the Honorable Court: 1. That the Petitioner is EDIN ARNOLDO CORDON-SOSA, and he resides at 717 REDEYE LN. LAS VEGAS, NV 89110-3813. EDIN ARNOLDO CORDON-SOSA is the Paternal Uncle of the Proposed Protected Person. 2. That there is one (1) proposed protected person: DANNA GISSELLE RIVAS SALGUERO, born on April 27, 2012, she will be 18 years of age in 2030. 3. That the Proposed Protected Person reside at 4640 E. Vegas Valley Dr. Las Vegas, NV 89121 . That the Proposed Protected Person has been resident of the State of Nevada since September 10, 2021. 4. The name and last known addresses of the relatives of the Proposed Protected Persons that is within the second degree to consanguinity is attached as "Exhibit 1". 5. That this Petition also requests Special Factual Findings for a Special Immigrant Juvenile Petition for Proposed Protected Person. 6. That the proposed guardian has never been convicted of a felony or judicially determined to have committed abuse, neglect or exploitation of a child, spouse, parent, or other person. 7. That ERICK ESTUARDO RIVAS is the natural father of DANNA GISSELLE RIVAS SALGUERO, and that said parent abandoned the Proposed Protected Person by failing to provide proper food, clothing, shelter, education, medical care, or other necessary care for the child physical and emotional needs, and that since September 10, 2021, the Proposed Protected Person has been in the care of their Paternal Uncle, EDIN ARNOLDO CORDON-SOSA. 8. It is necessary for Petitioner to be appointed Guardian of the Proposed Protected Person in order to provide for her support, education and welfare. 9. That the Petitioner is not a private of professional guardian and is not currently receiving compensation for services as a guardian to more than one ward who is not related to Petitioner by blood or marriage. 10. That the Petitioner does anticipate that the Proposed Protected Person will not need a Guardianship after attaining the age of eighteen (18). 11. That the Petitioner has not been suspended for misconduct or disbarred from the practice of law, the practice of accounting or any other profession which involves the management or sale of money, investments, securities, or real property and requires licensure in Nevada or any other state. 12. That the Proposed Protected Person, DANNA GISSELLE RIVAS SALGUERO, has no assets, income or liability and the proposed Guardian has not received any monetary funds for the care of the Proposed Protected Person. 13. That Petitioner, EDIN ARNOLDO CORDON-SOSA, is competent and capable of acting as Guardian for the Proposed Protected Person and hereby consents to act in this capacity. The Proposed Protected Person has been in the care of Petitioner, EDIN ARNOLDO CORDON-SOSA, since 2021. 14. That the proposed Guardian has filed identifying information with the Court upon the filing of the initial Petition. 15. The guardianship of the Proposed Protected Person is not sought as a result of an investigation conducted pursuant to Chapter 432B of the Nevada Revised Statutes. 16. The Proposed Protected Person, DANNA GISSELLE RIVAS SALGUERO, is not a party to any pending criminal or civil litigation. The guardianship is not being sought for the purpose of initiating litigation. The Proposed Protected Person, DANNA GISSELLE RIVAS SALGUERO, has not executed a durable power of attorney for health care, a durable power of attorney for financial matters or a written nomination of guardian. 17. Petitioner respectfully requests that bond in this matter be waived. 18. That a copy of Proposed Protected Person, DANNA GISSELLE RIVAS SALGUERO, birth certificate is being placed in the Court's confidential records concurrently herewith. WHEREFORE, Petitioner pray as follows: 1. That this guardianship be granted. 2. That this Court find that the Proposed Protected Person, DANNA GISSELLE RIVAS SALGUERO, has been abandoned by her natural father and reunification between the Protected Person and her natural father is not viable due to abandonment. 3. That this Court finds that it is not in the best interest of the Proposed Protected Person to return to her country of origin, GUATEMALA. 4. That the Proposed Protected Person is a dependent on this Court by virtue of this petition. 5. That this guardianship ends when the Proposed Protected Person becomes the age of eighteen (18). 6. For such other and further relief as the Court deems just and proper.
